VITA AI Terms & Conditions - Effective Date: 8/1/2024

Welcome to VITA AI! These Terms & Conditions ("Terms") govern your access to and use of the VITA AI platform ("the Platform"). By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you may not use the Platform.

 

1. Acceptance of Terms


By accessing or using VITA AI, you affirm that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.

VITA AI is an AI-powered health assistant designed to provide personalized health insights, track health patterns, and offer recommendations based on the information you provide. VITA AI does not provide medical advice, diagnosis, or treatment. All information and recommendations provided by the Platform are intended for informational purposes only and should not be considered a substitute for professional medical advice, diagnosis, or treatment.

3. User Accounts 


To access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User Conduct

  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

  • Attempt to gain unauthorized access to the Platform or its related systems or networks.

  • Upload or transmit any viruses, malware, or other harmful code.

  • Interfere with or disrupt the Platform or servers or networks connected to the Platform.

  • Use any automated means to access the Platform, including robots, spiders, or scrapers.

  • Engage in any activity that could harm, disable, overburden, or impair the Platform's functioning.

5. Privacy


Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and share your personal information. Using the Platform, you consent to our collection and use of your personal information as described in the Privacy Policy.

6. Intellectual Property


All content and materials available on the Platform, including but not limited to text, graphics, logos, icons, images, and software, are the property of VITA AI or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content or materials on the Platform without our prior written consent.

7. Disclaimers


The Platform and all content, services, and features available through the Platform are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, VITA AI disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. VITA AI does not warrant that the Platform will be uninterrupted, error-free, or secure or that any defects or errors will be corrected.

8. Limitation of Liability


To the maximum extent permitted by applicable law, VITA AI, its affiliates, officers, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or business interruption, arising out of or related to your use of or inability to use the Platform, even if VITA AI has been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless VITA AI and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

10. Termination


VITA AI reserves the right to terminate or suspend your account or access to the Platform at any time, without notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease, and any data associated with your account may be deleted.
